[Q&A] MEGA新的使用條款

On MEGA's 3rd anniversary we would like to thank the 35 million registered users in more than 245 countries who have uploaded more than 12 billion files protected by our user-controlled end-to-end encryption. Your comments and requests are helping us build and improve our user-encrypted platform for privacy and security.

Today we can announce some new and enhanced products and other changes:

    We have updated our Terms of Service to clarify some minor items.
    Code transparency is being provided progressively. SDK code has been available since 2014 and we are now disclosing code for our web client and browser extensions.

Updates to MEGA's Terms of Service and Privacy Policy

We haven’t updated our terms and policies since we launched in 2013, but we’ve learnt a lot from our operations and the great feedback we’ve had from our users.

We’ve taken all of that and updated our Terms of Service and Privacy Policy. These will apply to all registered users and people who access our website from midnight 20 February 2016 (NZ time). If you do not want to use MEGA on the new terms, you need to close your account by then.

We have made some minor corrections and clarifications and have reordered a few things more logically, but the main changes we’ve made are:

TERMS OF SERVICE

Changes to our terms: Previously, our Terms said that we could change them at any time and they would then immediately apply to all future use. We are now giving users 30 days’ notice of any change. Any user can therefore decide whether or not they wish to continue using E on the new terms before they apply.

Users who are on a subscription plan that expires after the 30 day period, can terminate during the 30 days period and get a refund of their unexpired subscription.

Termination of free accounts for inactivity or failure to respond: MEGA provides one of the most generous free accounts around – 50 GB of user encrypted storage – for free! However, some users have become inactive and we are unable to contact them. We also need to make sure that we can contact all our users should we need to issue any notices. We’ve therefore instituted an option for MEGA to terminate inactive accounts or non-responsive accounts after 3 months. Rest assured, MEGA does not want to lose legitimate customers, so you will receive ample notice before we do this. It’s an important reason though to make sure the email address in your account details is up to date now and is kept up to date, otherwise you won’t get that notice. Exclusions, disclaimers and indemnities: These have not really changed but we’ve highlighted them to remind everyone that they apply. MEGA is a cloud service so we can’t guarantee every aspect of the service. Users need to know that if they let someone else access their files, they are responsible and liable to us if that other person does something illegal with the file or is not meant to have access to it (which might infringe someone else’s copyright, for example).

MEGA affiliates: MEGA has grown exponentially in those 3 years. We now have over 35 million users. To provide the level of service and speed our users have come to expect, means we now have affiliated and related companies and resellers that provide some parts of our services from countries such as New Zealand, Luxembourg and Spain. MEGA has the advantage of being set up in New Zealand, which is one of the few countries formally recognised by the European Union as having adequate protections for personal information transfer.

We have therefore made it clear that data, including personal data, may be shared amongst these MEGA affiliates, related companies and authorised resellers but only for the purpose of providing the MEGA service.

Takedown Guidance and law enforcement: We have previously issued guidance on how we deal with law enforcement and third party requests for access to user data and takedown of allegedly infringing material. This policy has not changed but we have referenced it in our terms and privacy policy so it is easier to find.

Copyright counter-notices: New Zealand legislation does not currently have a formal DMCA style counter-notice process and since MEGA is not subject to US jurisdiction, the DMCA does not apply. However, we think having a counter-notice process is fair, so, on a voluntary basis, we have refreshed the policy we had before to make it clearer. We get a very small number of takedown notices as a proportion of the billions of files that we hold and have had only a limited number of disputes about takedown notices, but the counter-notice process is there if a user needs it.

Dispute Resolution: MEGA operates under New Zealand law and exclusive New Zealand jurisdiction. Any dispute between us and a user is therefore dealt with by arbitration in New Zealand under New Zealand law. However, to make it fairer for all users, the majority of whom are not based in New Zealand, MEGA will cover the cost of arbitration unless the dispute is frivolous or vexatious and users and witnesses may participate in the arbitration by video conference at MEGA’s cost.

PRIVACY POLICY

Clearer explanation of what information we hold: Apart from the changes referred to above relating to sharing of data between affiliates, related companies and resellers and relating to the Takedown Guidance Policy, the main change we’ve made to the Privacy Policy is to spell out more clearly the information that we hold when users use our services.

Advertising: We’ve also made it clearer that MEGA may use third parties to serve ads, with the usual ability of those advertisers to collect information, but not your private encrypted information! We don’t do this to any extent at all at the moment, but we may do in the future.

Those are the main changes. We encourage each user however to read the new Terms and Privacy Policy carefully. As noted above, use of any of our services after midnight on 20 February 2016 (NZ time) will mean that you have agreed to the new terms. CODE TRANSPARENCY

MEGA supports the safety and security of users, companies and governments by providing tools, technologies and services with the integrity and security of user-controlled encryption. To provide full assurance of that integrity, we will disclose the core code that operates the encryption. We welcome the review of security researchers to confirm that there are no backdoors in the MEGA systems and that the cryptographic processes are appropriate and reliable.

SDK code has been posted on GitHub since 2014. Today we are posting our web client code, Firefox and Chrome extension code and the mpENC code for multiparty encryption which is proposed for future implementation for group chat. Please send comments to crypto@mega.nz

簡單說:
1. 他們原本改政策會立即生效,現在會在改政策前 30 天預告。
2. 你的 email 要是正確的,要是有事聯絡不到你,3 個月後停權。
3. 3 個月沒有活動的帳號會被停權。

MEGA 被 ban 就是帳密打完一直停在登入,該帳號的檔案載點全部失效。

最近我也在加速備份到其它空間去了,順便檢查看看有沒有動畫漏掉沒備份到。
目前進度是所有英數字跟平假名開頭的動畫,片假名跟漢字開頭的動畫還存在國外主機上。
手邊好多事情都要停下來弄備份,不過為了將來還能拿出來發,只好先拼一拼了。

現在抓其實都算有點晚了,之前 MEGA 開始封大量分享者的帳號時就該早點下。
總之趕快抓吧,經歷 MU 被抄、MF 趕人、RS 跟 MEGA 紛紛改政策後,一堆網路上原有的資源都消失了。
希望大家能為了保護世界遺產(?)而盡一份心力,我這邊也在努力當中,等我忙完了會回來繼續整頓論壇。

目前收復了過去我發過的英數字開頭的動畫、平假名開頭的動畫,以及片假名ア行、カ行開頭的動畫。
片假名サ行到ワ行還有漢字開頭的全部仍在努力當中,粗估大概還有個兩三百部,漢字開頭的真的爆多。
我的版圖不單只是一般向動畫,成人向的也包含在內 (雖然都是蘋果君寄放的),還有 199x 年到現在的 AV、H-Game 等等。
所以這幾個免空改朝換代下來,我幾乎每兩年就有做不完的搬運工作...
